When CMTO receives complaints, the Inquiries, Complaints and Reports Committee (ICRC) can refer serious allegations (e.g., sexual abuse or other professional misconduct) to the Ontario Massage Therapists Discipline Tribunal (OMTDT), which is the Discipline Committee of CMTO. The OMTDT has issued the following decisions:

- Committed professional misconduct by engaging in sexual behaviour during a Massage Therapy appointment.

- Convicted of sexual assault on a client, this registrant committed professional misconduct by being found guilty of an offence that was relevant to their suitability to practise massage therapy. This same conduct was also sexual and physical abuse. The individual also contravened the Standards: Professional Boundaries, Prevention of Sexual Abuse, and Draping and Physical Privacy.

- Failed to maintain hundreds of client records and issued many receipts in her name for Massage Therapy treatments she did not provide, either at all or as described in the receipts.

- Did not create health records or maintain financial records for many clients over multiple years and practice locations. He also issued or allowed clinics to issue Massage Therapy receipts for treatments he did not provide. When investigators for the insurance companies asked him to confirm information contained on those claims, he gave them false information.

- Did not keep financial and treatment records for a client he treated several times in 2022 and although he obtained verbal consent from the client to treat sensitive areas prior to treatment, he did not obtain written consent, as required.

- During two Massage Therapy appointments, consent was not properly obtained, including written consent for treatment of sensitive areas. There was also failure to properly secure draping and maintain appropriate spatial boundaries with the client.

- The College did not prove that the Registrant touched, prodded or rubbed a client’s arms and hands with his erect penis through his clothing during a Massage Therapy treatment. Consequently, the Tribunal made no findings of professional misconduct.

- Treated the client’s upper inner thighs and breasts without consent, touched prohibited areas of the client’s body, and made sexually suggestive remarks.

- Submitted false insurance claims for unprovided Massage Therapy and other services, allowing the client and their family to receive equivalent services at different times from him and others. He also falsified treatment notes and receipts submitted to both the insurer and the College and failed to maintain proper treatment records or issue receipts during the period of the billing misconduct.

- Treated clients’ sensitive areas without obtaining prior written consent and touched areas of the clients’ bodies that should never be touched during a Massage Therapy appointment that were sexual in nature. He also did not maintain client records and failed to comply with other professional obligations related to consent and draping.
