Proposed By-Law Changes will Ensure Relevant Information about Registrants is Made Public, and Thereby Enhance Public Protection.

In October 2014, the Honourable Minister of Health and Long-Term Care, Eric Hoskins, wrote to all the Regulated Health Colleges in Ontario asking that they strengthen existing transparency measures. He requested that the Colleges introduce new initiatives that will increase transparency in College processes and decision-making that will make more information available to Ontarians.

CMTO is deeply committed to transparency and developed a transparency action plan, which includes expanding the information that is contained on the public register (information that is publically available). Therefore, at its September 21, 2015 meeting, Council directed that proposed amendments to By-law No. 8 – pertaining to the Register and Registrant Information, which outlines what information should be placed on the public register – be circulated to stakeholders for comment. The attached comparison chart highlights the proposed amendments and provides the rationale for the amendments.

To assist the public in making informed choices – a goal that is consistent with many of the other Health Regulatory Colleges – Council is proposing that, effective March 1, 2016, information posted on CMTO’s public register should include:

  • Decisions of the Inquiries, Complaints and Reports Committee (ICRC) that result in a
    • Written or oral caution;
    • Specified Continuing Education or Remediation Program (SCERP); and/or
    • Referral to the Discipline or Fitness to Practise Committee.
  • Findings of professional misconduct, incompetence or incapacity in other jurisdictions;
  • Criminal findings/convictions; and
  • Criminal charges and bail conditions.

Prior to finalizing these proposals, Council will carefully consider all comments and suggestions from our stakeholders, keeping in mind the College’s mandate to protect the public interest.
